Tobacco License Hearing Officer Contractor Job Posting

The City of Nerstrand is searching for two independent contractors to serve as hearing officers to adjudicate code violations related to our tobacco ordinance. Key duties include scheduling and conducting hearings requested by the business owner related to tobacco violations, reviewing evidence (including hearsay), and conducting hearings under oath. Upon conducting the hearing, and based on a preponderance of evidence, the hearing officer is responsible to issue written findings of fact and conclusions which are final and appealable to the county district court per the ordinance. The hearing officer must maintain impartiality, including prohibiting improper, ex parte communication (contacting the hearing officer about the merits of the case without all parties present). The qualified applicant must be a neutral third party, not directly employed by the City of Nerstrand, nor employed by the Rice County Sheriff’s department, nor the business requesting the hearing. Salary range is $80 per hearing
